FINAL APPROVAL GRANTED IN CAPITAL ONE DATA BREACH LITIGATION SETTLEMENT

On September 13, 2022, Judge Anthony J. Trenga finally approved settlement for a certified settlement class of consumers for litigation arising from In re: Capital One Customer Data Security Breach Litigation, Case No. 1:19-md-02915 (E.D. Va.).  More information about the settlement can be found here; the final approval order is available here as well. LGN partner Karen Hanson Riebel serves as co-lead counsel for the class, and has been assisted by partners Kate M. Baxter-Kauf, and Gregg M. Fishbein, senior counsel Maureen Kane Berg and Joseph C. Bourne, paralegals Carey R. Johnson and Amber M. Raak, and many others at the firm in working on the case.

Direct Purchaser Class Represented by LGN Certified in Pork Antitrust Litigation

LGN represents direct purchasers of pork products in price-fixing litigation that has been pending in the District of Minnesota since 2018. LGN recently achieved a critical milestone in the litigation, as the district court (the Honorable John R. Tunheim) certified a class of direct purchaser plaintiffs, allowing their claims to proceed on a classwide basis. The court also appointed LGN and their co-counsel at Pearson Warshaw, LLP, as co-lead class counsel. The defendants sought appellate review of the decision, which the court of appeals denied.

LGN’s Pork litigation team (Joe Bruckner, Brian Clark, Joe Bourne, Arielle Wagner, Steve Owen, Sarah Lundberg, Amber Raak, Elizabeth Schindler and Cheryl Evans) looks forward to continuing to litigate the class’s claims as the case continues.

LGN Appointed Class Counsel in Farmers Insurance Group Litigation

Lockridge Grindal Nauen, along with co-counsel Hellmuth & Johnson PLLC and Sawicki & Phelps, P.A., have been appointed class counsel in a groundbreaking case challenging secret limitations created by Farmers Insurance Group on the ability to use their auto insurance to treat with the health care provider of their choice following an accident. The Honorable John R. Tunheim (D. Minn.) certified a damages class and an injunctive class that together include hundreds of thousands of Minnesota consumers who allege they bought Farmers auto coverage that promised to pay for all reasonable expenses for necessary medical care, when in fact Farmers had secretly limited consumers’ ability to treat with certain providers in Minnesota. As a result of these limitations, LGN’s clients testified they were unable to treat with culturally competent providers after they were injured in car accidents, and all Class members allege they paid for auto coverage that broadly promised their care would be covered, when in fact the coverage they received was far less valuable. LGN’s team includes partners David Asp and Kristen Marttila, and associates Jennifer Jacobs, Stephen Owen, and Derek Waller, with support from Samantha Girard.

FINAL APPROVAL RESOLVES PEANUT FARMERS ANTITRUST LITIGATION; $102.75 MILLION IN TOTAL SETTLEMENTS ACHIEVED

On July 27, 2021, a federal judge in the United States District Court for the Eastern District of Virginia granted final approval for the $45 million settlement with Golden Peanut, Co.   This ruling resolved the In re Peanut Farmers Antitrust Litigation.  Previously, the judge had approved settlements with the two other defendants, Olam Peanut Shelling Co. and Birdsong Corp.  In total, in just under two years of litigation, the Lockridge Grindal Nauen (LGN) team and its co-counsel secured over $100 million for America’s runner peanut farmers.  In recognition of their efforts, the American Antitrust Institute selected the Peanutslitigation team to receive its prestigious Outstanding Antitrust Litigation Achievement in Private Law Practice award in November 2021. At the same time, the American Antitrust Institute selected LGN attorney Simeon A. Morbey to receive its Outstanding Antitrust Litigation by a Young Lawyer award for his work in the Peanuts case.
